  1. What are you talking about Smalls? You sure as hell can own your own fighter. I don’t know anyone who owns Mk 82s but in theory they wouldn’t be any different than claymores which are legal to own under NFA. You must register and pay your $200 tax stamp to register each one as a destructive device. Your second paragraph is the point-how the do people who talk about “the shoulder thing that goes up” write a law that doesn’t end up banning belt loops?
  2. It’s a novelty sure, but let’s get at the root cause-why is a bump stock a thing? It’s because the Hughes amendment stopped registration of new machine guns. If I could spend $10 on different parts and $200 on a tax stamp to register a machine gun as an NFA item then the bump stock wouldn’t have been invented and every gun capable of this kind of firing rate would be registered within the NFA construct. As it is, gun control (Hughes amendment) artificially limited supply so prices for legal full auto are through the roof. So someone invents the bump stock which the ATF said was legal! Let’s stop pretending that more regulation will achieve the desired effects

    Poor choice of words on my part. The $200 tax stamp is a one time thing. The stamp I was referring to is a postage stamp for mailing the 5320.20 through USPS....what are they, 69 cents these days? While your point is valid, the consequence is insignificant.

  5. Invalid comparison because cops have a duty to protect others. I'm pretty sure there's case law saying they don't have to park in front of your house because you think you've been threatened, but my point is that while we have a duty to retreat (depending on state) they do not. You have to take driver's ed before you can get a driver's license. Driving is not a right, but driver's ed is (or at least used to be - no idea on current HS curriculum) taught in schools. Gun ownership is a right. I'd love to see some NRA Eddie the Eagle stuff taught in public schools. You want to do something for the children? Then teach them how to use them safely.
  6. I'm from Texas and while I'd love to agree with you with Republicans like this...I don't know what to say other than if you want to ban it for yourself then don't fucking buy it. Rep. Bill Flores (R-Texas), a gun owner himself, may be the first Republican in Congress to call for a ban on bump stocks. “I think they should be banned. There’s no reason for a typical gun owner to own anything that converts a semi-automatic to something that behaves like an automatic,” Flores told The Hill in an interview just off the House floor. “Based on the videos I heard and saw, and now that I’ve studied up on what a bump stock is — I didn’t know there was such a thing — there’s no reason for it,” Flores said. “I have no problem from banning myself from owning it.”

    My mistake - didn't mean to post in this thread in addition to the WTF thread where we've been having this discussion. To your bolded comment above - do you have any NFA items? Because I do and that's not how this works. Form 4 used to require CLEO approval for individuals but not for trusts. The requirements changed in July 2016 to require every form 4 to NOTIFY CLEO. 2 key points - now even if a trust owns the item you have to notify and second that individuals no longer require approval, just notification. For PCS you don't file a Form 4, you file a Form 5320.20 to transport NFA items across state lines. The 5320.20 takes 4-6 weeks to get back and costs you a stamp and 10 minutes to fill out. The Form 4 costs you $200 and 6-9 months (really optimistic wait time) to get back. Otherwise I agree with everything you said.

    Here's some food for thought: The only reason bumpfire stocks are a thing is because they cost $60 and circumvent the NFA with it's artificially restricted number of legal to own full auto guns (e.g. M16 costs are in the neighborhood of $25k). If you could buy any AR lower for $40, pay your $200 tax stamp and register it as a machine gun then everyone who has a machine gun would be on the registry. But the gun control enacted with a 1986 cutoff for registering machineguns has cut off supply (you can't make more) while the demand has increased. This is known as supply and demand. Gun control restricted supply so the price went through the roof. And bumpfire stocks aren't firearms so you can order one from Brownell's and have it mailed to your house. I think bumpfire stocks are dumb, but no one would buy them (so they wouldn't have been developed) if you could have the real thing at a free market price.
  9. Close - I'd substitute the word restored for retained. If they're too dangerous to own guns then they're too dangerous to be on the street. Conversely, if they've paid their debt to society/been rehabilitated then their rights should be restored. edit: Hacker said pretty much the same thing. So I'll also add that there should be enhanced sentencing guidelines for crimes committed with firearms if "we have to do something!" That serves the purpose of keeping those convicted off the streets. It shouldn't be a crime to merely possess a gun with a barrel shorter than an arbitrary 16" *rifle* or 18" *shotgun*.
  10. I'll respond to your second paragraph. Newt Gingrich wants to add bumpfire stocks to the NFA. I'd go for that if they repeal the Hughes amendment or open the registry to allow new registration of post 1986 full auto. Talking to a Fed LE buddy, I like his idea - get rid of the NFA altogether and add sentence enhancement for using SBR/silencer/full auto/whatever you want to toss in here during the commission of a crime. It would also be nice if the ATF enforced some of the gun laws already on the books (e.g. charge people when they attempt to illegally buy a gun)
  11. What is this gunshow loophole? Private face to face transactions were not included under Brady. Characterize it as a loophole if you like, but in reality it's perfectly legal under the law as written. The real issue that laws are written by politicians who have no clue about "the shoulder thingy that goes up." How is someone with that level of expertise going to write a law banning bumpfire stocks that doesn't also outlaw belt loops? (No, i'm not being sarcastic).
