M2 Posted October 30, 2014 Share Posted October 30, 2014 Yep, the Ninth Circuit Court of Appeals ruled that actually wearing medals or decorations not earned is NOT protected by the First Amendment, as it is conduct and not speech... http://www.stripes.com/news/report-court-rules-wearing-unearned-medals-a-crime-1.311205 So to recap, a person can lie about it and be protected as long as they aren't doing so for financial gain (fraud), but they can't wear them.
